Apparently everyone WANTS to pay taxes they don't owe? Me? I'm too scared NOT to pay, even though I don't owe them. Maybe some day I'll be brave enough to stop paying what I don't owe.

Just has to hang head and shake in painful discussed. Different rules? Hmm, where else in America are you guilty until you prove yourself innocent? Even when a sheriff arrests someone, it is on a preponderance of evidence, continuing to afford innocent until proven guilty in a court of law. A tax court is not a judicial court at all but, rather an executive branch hearing (in a judicial setting) where the inventory (the taxpayer) is expected to expose his entire world while remaining guilty until proven innocent. If an agent claims that an individual makes twice as much as he does, for any reason, how can the inventory prove his correct salary? He can’t, even by exposing the inventory's entire world can a negative or false be proven. The inventory, being guilty until proven innocent, has to pay taxes based on the IRS agent’s unsupported assumptions. And, when has anyone working for the IRS ever been accused of telling the truth. Legally, you can’t even rely on their word when asking for their help.

oops with a p.s., forgot to rate it. Tax court is set up to violate a sovereign's 5th amendment rights in the most egregious manner possible by gaining as much evidence against the inventory as possible. This is of course denied by the IRS but is in reality the actual result.

Income tax is just as voluntary as when a police officer asks you to come along peacefully or whether or not he should use force. It is amazing that intelligent people think income tax is voluntary. It is voluntary just like stopping for a stop sign is voluntary. Children may think that stopping at a stop sign is foolish when no one is there to see you. As adults we usually learn the wisdom of the Stop Sign. The Tax Return is designed to be completed by adults under the penalty of perjury. It is required by law just like the stop sign. Unfortunatley in our society of imperfect people some times we have to penalize those who fail to stop or on the other hand fail to file and to pay.

The stop sign analogy is all fine and good, but that doesn't change the fact that Mr. Avis said what he said testifying before Congress, and that makes one go hmmm when talking about tax law. An intelligent person is one who questions apparent discrepencies in wording and logic, not someone who obeys what is told to them without question.

Intelligent People Would Know The Difference Between MANDATORY And VOLUNTARY. This Essential Difference Should Have Been Considered By You Before You Started Off On Your Hypothetical Construction Of Tax And Traffic Laws. BRUCE Your Argument Is Not Strong Because It Relies On Hypothetical Situations Created By You. If Your Argument Is Going To Make Any Sense It Has To Be Based On The Facts And On Reality Not Some Derivative Of Reality. The Rights Of The Fifth Amendment Are REAL Not Hypothetical. Real Adults, Mature Adults Know Their Rights. You Obviously Don't Know Your Rights So Your Entrance Into Adulthood Has Been An Unsuccessful One. What A Pity.

The present system is a failure. It was an emergency measure, adopted under the pressure of war necessity and not to be counted upon as a permanent part of our revenue structure■. Ways will always be found to avoid taxes so destructive in their nature, and the only way to save the situation is to put the taxes on a reasonable basis that will permit business to go on and industry to develop.

The IRS tax code has become so convoluted since its inception, that almost nobody really understands its basis, including IRS employees. There are all sorts of codes to indicate that the citizen is engaged in various excise taxable acts. It is possible to have those codes corrected to reflect what excise taxes you really owe -- which for most citizens is NOTHING. The average American has been duped into believing he/she owes anything -- employers are intimidated into withholding tax revenues, and the citizen must apply to have them refunded. If there was no withholding, the tax system would collapse. Sales taxes (excise taxes) are the only lawful way to tax the sovereign citizen -- the founders knew it, and only authorized excise taxes to Congress. Lincoln imposed the first federal income tax along with a military draft -- it was do or die, and it cost him his life and ALL Americans' protection of their liberty as well.

In defense of the Individual sovereign the AFFIDAVIT OF REVOCATION comes forth. In dealing with Employers, " Withholding Agents" the 515 Statement is used in lieu of a W-4. The W-4 for the purpose of withholding is for the use of non-resident aliens and foreign corporations or any other entity who wishes to enter into VOLUNTARY AGREEMENT with an employer that the employer will withhold monies from the paycheck. Publication 515 instructs the " employer " withholding agent as follows on page 2 column 3: " If an individual gives you a written statement , in duplicate, stating that he or she is a citizen or resident of the United States, and you do not know otherwise, you mat accept this statement and are relieved from the duty of withholding the tax."
