Yes, Congress has the duty to declare war; however, it's a lot easier to allow someone else to do it. The Republican congress gave GW Bush carte blanche to go after terrorism any way he had to. This done while America was in a state of emotion after 9/11. How very convenient that phrase "Police Action" is. That said, the doctrine of Preemption is even more convenient IMO. There is no such thing as 'hate speech'. Perception is the issue here...One perceives what One wants to. Even the phrase "I'd like to kill you" is generally said out of emotion rather than deliberately. Hate speech? Depends upon who is hearing the phrase. Ah, but let the lawyers into the discussion and we're probably looking at some kind of legislation aginst using that phrase...as if it were possible to enforce such a law.
