I wouldn't say that it's "due process of law" when cops can take your car, your boat, your home, or whatever without even charging you with a crime. Constitutional arguments are not permitted in court -- a judge tells the jury that he/she is the judge of the law, not them, which is not true and counter to the due process of law. Indeed the War on Drugs has granted arbitrary powers to police and the State -- this is how totalitarian governments are founded. The Patriot Act and the recent National Defense Authorization Act have granted the power of police and government to arrest people without charge and hold them indefinitely on nothing more than an anonymous tip -- no evidence or warrant need be presented.
