I think last week's discourse about guns, and the complete disconnect between people not sharing the same POV, clearly showed this distinction exists. As Anonymous points out the right to bear arms for the founders had everything to do with the goverments ability to call up a militia and nothing to do with arming the populace up the wazoo with guns of mass destruction to be used on their fellow citizens at their discretion, provked or not. The innate power of the strong in nature to overpower and subjugate the weak is the umbrella rule of the jungle that a civilized society works to overcome by judiciously creating laws that protect against oppression, discrimination, unjust war and man's general inhumanity to man..not to mention what laws are needed to protect even Nature from man's greed and destructive tendencies.
