Is the "fundamental flaw" a reference to natural law's ultimate superiority to legal positivism's criminal actions ? Is the, "cannot and should not", a back handed attempt to illustrate the illegitimacy of victimless crimes ? Does the judge's binding and hypocritical decisions on fundamentally flawed legal positivism indict him as a criminal (making all previous decisions void) ? Consenting adults cannot commit crimes against themselves -- if they want to charge themselves with a crime, then they can commit themselves to a mental hospital for treatment.
