Reply E Archer, NYC 3/30/10 Reading up a bit on FDR's New Deal, which was as unconstitutional as mandatory health insurance is today (which really rankles me, too), we find that the National Industrial Recovery Act (NIRA), the Act of June 16, 1933, authorized the President to regulate industry and permit cartels and monopolies in an attempt to stimulate economic recovery, and which established a national public works program. But in a major constitutional ruling the U.S. Supreme Court held Title I of the Act unconstitutional on May 27, 1935, in Schechter Poultry Corp. v. United States, 295 U.S. 495. The government's argument, again, was that the authority was granted via the "good and welfare" clause -- a legislative trick for passing almost anything. So there is indeed precedent for repealing mandatory health insurance for which there is NO authorization given by the States or People for such a duty to Washington, DC.
